The seventh amendment of the United States Constitution is a part of the Bills of Rights. This amendment id related to the right of the jury trial in particular civil cases as well as inhibits courts from the overturn of a jury’s fact that are being found. This amendment was firstly introduced in Congress in the year 1789. James Madison was the person who introduced this amendment. A revised version of this amendment was stated in 28th September 1789. The amendment as proposed by the Congress in the year 1789 states the following:
“In Suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise re-examined in any Court of the United States, than according to the rules of the common law.”
The jury members that are stated to be present according to the amendment are a six-member jury. The stated clause forbids any court from the session of re-examining as well as overturning any of the factual determinations that are made by a jury henceforth providing guarantee that the facts which are decided by the jury is restricted from the procedure of re-examination at any later stage. Moreover, exceptions are possible if any serious legal errors are found and in accordance to it evidences are available as well as prior evidence were found to be inefficient in any manner. In such cases re-examination may be conducted by another member of the jury ensuring the decision to be left over to the people for the final verdict.
